I have H1-B visa and my wife has H4.We just applied for a green card.After getting a green card in the case of divorce I'll have to send a part of wages to her, won't I. What will happen if we divorce before getting a green card? Will I still have to pay?

    The results of a divorce are separate from a green card issue. If you divorce her and are ordered to pay alimony or other monetary contributions, like from the sale of community property, that is binding on you whether you have a green card or not.

    What plays a bigger role is what may happen if you have to return to your home country and it is different from hers. Trying to enforce the terms of an American divorce across two national boundaries and two different legal systems may prove to be impossibe.

    It may be impossible for her to force you to pay if you live in Madagascar and she lives in Sweden, for example, if Madagascar does not have the programs in place to enforce legal debt payments incurred as a result of court decrees from foreign countries.

    Many American women find themselves unable to collect alimony when the ex-spouse runs back to their home country.
