The Orange County Register is firing their delivery contractors because they filed a case action suit against them. They claimed that the OC Register was simply avoiding paying them employee's benefits by making them contractors. How would you rule?

I would need to know the facts about their employment. You can only be an independent contractor if you are, in fact, a contractor. The California Supreme Court has set out a list of factors (called "Borrello factors after the case that creaetd them) to use to determine if someone was an employee or a contractor.
