Call a lawyer, this isn't something that AB can tell you. I am facing the same thing and even if you can prove malpractice, it's not going to be a quick process to deal with. I was misdiagnosed and treated for a sprain in my back for almost a year, was told I could keep doing everything normally, jogging, bicyles etc. Now I am told a couple of vertabrae have been broken in my back and I caused more damage from the doctors orders. Call an attorney! I hope you feel better soon.

My friend's mother successfully sued those assholes.
Get a lawyer.
If you have substantial proof of medical negligence on the part of your doctor and also if you could find two doctors as witnesses to corroborate your grievance, then you could go for a lawsuit and win the case.
But I am sure you will find these proofs and witnesses difficult to find.
No harm consulting a lawyer though, it will only cost you his fees!
i doubt that u'll get a real answer off the internet (no offence to anybody) your best bet is to call a lawyer and see what he/she says
This reminds me of when my wife had an ovarian cyst. Her doctor never said that if it ruptured it would be painful, but not anything worth hospitalization for. Well one night it ruptured and we spent all evening at the ER... all for nothing.
It wasn't her doctor that we had to threaten legal action against, but instead the hospital that "treated" her that night. It was a University hospital, and the first night of a new term... the PERFECT opportunity to run excessive and unnessesary [expensive] tests on my wife to give the students some training.
Contact a lawyer that specializes in medical malpractice. So you know, these cases are very difficult to prosecute and prove, mostly, because all doctors stick together no matter what and won't testify against another doctor, even is he kills you with his own hands

It will difficult to make a case against a doctor, unless its a major mistake on his part and obvious.
Icy check and see! I wish i had! The ob i had at the time told me my pap was fine then called me in a month later and told me i had cancer! I would feel a lot better now! You only have a certain amount of time to file a suit!
Talk to a lawyer who specializes in these types of cases. They could be more accurate in their advise. I dont know and dont want to steer you wrong + 5

It depends on the kind of mistake that was made and if you would be able to prove it, medical negligence cases can get very complex and difficult to prove, perhaps you should discuss it with a lawyer, sorry that this happened and that you are fed up, I hope things will get better for you soon.

In that case, you need to determine if the doctor was negligent under the standards of other doctors in your community. Even though you call this a "mistake," it may not be a mistake. If you think most doctors in your community would have acted differently, then concult an attorney.
I'd check that out with a malpractice attorney. They'll usually take the case on a contingency basis. Which basically means only if they think you have a case. Consultations are usually free so it's worth looking into. I hope you feel better soon:)

You're reading My dr made a mistake and now i am facing more medical care than would NOT have been needed if treated sooner; i might even have to go into hospital. i wonder can i sue ? i am fed up.

thank you naamah i put in legal i was hoping a real lawyer would see to calm me till morning.. i am upset and angry i can deal with upset and pain but anger i have issues. thank you so much sigh sorry for yours as well.
