I was bit by a brown recluse in a motel in south carolina while visiting family, i live in ohio, and was hospitalized for 11days. would the motel chain be responsible for my pain and suffering?

    You could try, but I am guessing that you will be wasting the money on an attorney and it would be ruled an act of god. Spiders/bugs are everywhere.

    Whats with people always trying to sue everyone every chance they get? You were bit by a bug, It could have gotten in when you open the door.

    This could happen to anyone anywhere. I cannot imagine any reputable lawyer taking on a slim case like this. I was stung by a scorpion at a rented summer home but it NEVER dawned on me to sue the owners. I was bitten by a brown recluse on my own property but I never thought to sue the seller of the property.

    This sounds incredibly frivolous to me. If a lawsuit is determined to be frivolous you can be penalized up to $25,000 in court, not to mention the possibilities of a countersuit forcing you to pay money.

    You represent everything that's wrong with our legal system today.

  • and you named yourself brown recluse? Okay. The motel chain might very well be, but they may have a disclaimer if that kind of creature is a local area pest. If you had to endure 11 days of hospitalization, I would certainly get myself a good lawyer and at least hear a consultation.

    Maybe. It would likely depend upon whether the hotel was on notice of an infestation or dangerous condition. Your pain and suffering wouldn't be the only thing you could recover. You could also ask for all medicals--being hospitalized for 11 days is expensive! And, it doesn't matter if it was paid for by your health insurance. I'm sure you could find someone in South Caroline to represent you on a contingency basis (no money out of your pocket) OR because you both live in different states (depending upon the monetary amount at issue) you could sue in federal court.

    You can get bitten by a spider anywhere. It can crawl into any building, or you can get bitten outdoors. It could have just as easily happened at home. I understand that it was a terrible experience. But why would you want to make someone else miserable for your misfortune? If you think its a get-rich-quick opportunity, remember that the lawyer is going to take half. So the person who is really going to get rich out of this is the lawyer. Is that worth it?

    No, let nature take its course. The laws protect issues of hygeiene and safety, not spiders that are external circumstances beyond our control..It is simply an act of nature, not negligence, poor customer service, or poor business on the behalf of any motel.

    AN example of nature vs. legal rights would be this: imagine you were walking thru a park and got struck by lightening? This is a catastrophe of nature and the park does not hold an legal responsibility on the part of the park and recreation; however, if you were walking thru the park and there was no sign or warning of construction being done on site and you tripped and fell on concrete or in an unseen hole and broke your foot; this would be a liability and fault on parks and recreation
