  • A minor can sue, but they have to do it through someone that is called a "guardian ad litem." [This may not be the case with an emancipated minor]. There may be different names in different jurisdictions (jx). A Guardian Ad Litem (GAL) is basically someone that is appointed by the court to look after the minor's interest. The court can do this on its own, but more frequently, the minor's attorney requests that a relative be appointed. It is often the parent unless that parent is also a party to the lawsuit. It's a form that is easily obtained if you want to do it yourself. I don't know what jurisdiction you are in or what court you are interested in suing in--this makes a difference.
