I think there's something about the system of balance and checking. We vote for the people who control that... I guess that's what it means.

We actually did vote for Sotomayor and her kind. Obama is a left wing "judicial activist" kind of politician, as is Madame Soña Sotomayor. She answers questions much like Barack Obama did himself. He spun things his way, with but a touch of lofty politicized piety and charisma. Just as she has done, is doing and will continue to do so.

A large majority of people are not qualified to examine judicial rulings and the associated arguments to help determine fitness for the job. Thus we leave it to our elected representatives to "advise and consent" on the nomination, no matter how partisan-ly they may do this job. Could you imagine the campaigns should people be allowed to "run" for Supreme Court Associate Justice? The mind fairly reels! lol

Because that would lead to campaigns, which would lead to promises, which would end even the pretense of impartiality.

Most ordinary folks have no clue about the demands set upon a sitting Supreme Court judge plus giving people a vote we risk winding up with Simon, Paula, Randy deciding who gets to be set free. :D

I think we should. A panel of citizens chosen by public lottery, similar to jury duty but without the attorneys being able to pick and choose the jurors, who would choose the candidates that will run for any available seat, thereby alleviating any risk of interference by corporate and private interest groups. Of course, there WOULD have to be a moderator of some kind to inform members of the panel of each candidate's experience and personal data.

Most of us have no idea what should be the qualities of a Supreme Court judge. In fact, most people don't understand that the Supreme Court doesn't make or decide law but rather interpret and apply the existing law to the cases they hear.

Forget the theory. In practice it's a party political appointment. You voted the President and the party hacks in.
