Remember the posterized image of Obama painted by LA artist, Shepard Fairey? He just copped a plea here in Boston for painting what the city sees as graffiti on property that wasn't his to paint. http://www.boston.com/news/local/breaking_news/2009/07/shepard_fairey_1.html

When it's created with the permission of the wall/truck/etc owner. Otherwise it's a crime.

Graffiti is art. Might not be the art in the museums but it is a form of art. Its looked down at because when you ask the average person about graffiti the first thing they think of is gangs. And the fact that graffiti is urban art, and you already know what people say about urban cities, its not positive. I understand it because I grew up in a urban city and I know artist, and they are not gang bangers, they are the coolest people you have ever met.

When you are paid.

That kind of art would be in the eyes of the beholder. When more than a few would stare at a specific graffiti and say "that looks good!", it would be considered a form of art.
-
When they ask for and receive permission to put their "art" on a building. Until then it is just vandals with spray cans.
-
When it's meant to be that way and good enough to be considered that way.

When it is "posting art in unauthorized spaces without the consent of the owner."
-
When it has the narrative content, communicative power, careful planning and execution characteristic of art. Just because it's illegal doesn't mean it ISN'T art, and just because it's visual doesn't mean it IS art.
-
when it tells a story or has some kind of meaning. or if the artist is getting paid.
-
when its spontaneous, carefully drawn and carries a strong message
-
graffiti's are done so the artist can express him/herself.. that's art, isn't it? i suppose to another person it must be when the graffiti actually means something to them. so to some a graffiti that says "fuck bush" might be art, but to others a crime. you know what i mean?
-
When people don't complain about it.

I guess I am not of the popular opinion here but I really enjoy seeing the graffiti on trains as they pass through my little town. Sometimes it is juvenile, and that is not really what I like to see but all artists start somewhere. As for the answers which state it's art if you are paid for it, well, I've seen so called art that people have bought which I wouldn't give any amount of money for. I guess what I'm saying is that my opinion is that it's art if the person looking at it views it that way.
