The deductible does not have anything to do with who was at fault for the accident. The deductible is simply your part of the financial responsibility for your vehicle to be repaired by your insurance carrier. With that being said, once you retain a lawyer to represent your interests, it is very possible as part of the
negotiation strategy, that the lawyer ask for reimbursement of the deductible that you paid. Your insurance company may also be able to recoup these monies for you.
if you have full coverage, (not full tort) your ins co will pay for your damage, in the normal collission they would collect all their out of pocket from the other insured and you would get ur deductable back
The point is u should get what you payed back form the ins co. If they won't pay you can sue the other driver for it

You're reading A car hit my car from behind into the back of my car in CA. Since the driver has the same insurance company as me, the insurance company made me pay the deductible. Is that legal even though it was not my fault?
