An ex boyfriend is suing me for £40,000 off my morgage, even though he has never paid towards my morgage or contributed to my home. He has receipts for diy towards my home, even though my family footed the bill. He has always had his own home. Can he sue

Of course he can sue. People can sue about nearly anything.

I'd say the more pertinent and important question is, "Can he win?"

The receipts for the DIY should show how they were paid. If they were paid for with your credit card or one supplied by your family, you're home free.

Sure he can sue, and you can counter-sue him for his lawsuit. Good luck.
