  • You can babysit for your friends' kids all you want. However, if you're advertising yourself as a day care service (i.e., on Craigslist, in the newspaper...) and someone stops by pretending to be a client and asks to see a license, you'll be fined pretty damned heavily.
  • It depends on how many kids and, as Lady said, if you advertise or not. If people are already using you as a babysitter and you charge them money for it, I think you just need to make sure you are only taking care of the legal maximum and not advertising yourself as a 'daycare provider'
  • It's not illegal, but not a very good idea. If you had a dispute with a parent about something and had to go to court, you would have no "leg to stand on". The courts would not back you up. It's a better idea to just get the license. It will help you look more professional and attract more clients.
