I live in NJ. My ex and I are going to have to go to court soon to decide who will get custodial custody of our five year old son, so he can start school. What are some of the factors the look at when deciding who gets custodial custody?

    The parents gender is very impertant. If you are the mother, you will have a lot more luck. Other factors include the reason for the divorce (abuse, etc), and financial situations (aka. can you support a child on your own.)

    Well, the court is gonna want to see about mental health, carrer status and income, criminal history, history of violent behavior, and so on...

    Basically, they'll want to see which one of you can support the boy better. It's not whether one is capable, but who is the safer bet. You also have to consider the boy's personal preference.
