I live in NJ. My ex and I are going to have to go to court soon to decide who will get custodial custody of our five year old son, so he can start school. What are some of the factors the look at when deciding who gets custodial custody?

The parents gender is very impertant. If you are the mother, you will have a lot more luck. Other factors include the reason for the divorce (abuse, etc), and financial situations (aka. can you support a child on your own.)

- Well he doesn't even have a job...which is the reason for the divorce in the first place. He can't hold down one, he has no relatives living here. When my son is with him, it's just him and my son, no friends of relatives. I live with my parents, whom help me big time with watching him while I work. I am just so scared to death that I will somehow be the non-custodial parent. I don't know how I can deal with that.

Well, the court is gonna want to see about mental health, carrer status and income, criminal history, history of violent behavior, and so on...

Basically, they'll want to see which one of you can support the boy better. It's not whether one is capable, but who is the safer bet. You also have to consider the boy's personal preference.

- I don't think at five years old he's able to make a choice as to which parent he lives with full time. I would never put him through that he's too young and would feel like he has to choose between two people he loves very much. I don't believe also that leagaly a child can say which parent they want to live with until they are 10 or 12 years old.
