In Canada, if you are going through a legal separation (but are not yet divorced), are you able to be common law with a new partner?

    You can live with someone, if that is what you mean. You cannot claim to be 2 people's spouse at the same time and I doubt that trying to claim common law status with someone else would help in your divorce proceedings.
