You are not detained.You are free until your court proceedings are complete and a sentence is handed down & or your bail is revoked.Think about all those who dont make bail being unable to walk to a fridge in the middle of the night or open the front door just to look out at the sunny sky & smell the fresh breezes..Do you think it would be justifiable just because they didnt have the means to set bail to suffer and do their time while a person out on bail would be counting their "free time" towards their punishment?If that were the case there would be less prison population than there is..
  • usually no, if the judge finds you guilty and sentences you to time served, it means all the time u were in jail if ur sent up for three years, the actual time spent in jail is time served
  • Time served is for those people who *couldn't* get out on bond.
  • If you are out on bond, you are not seving your time.
  • If you were in jail, waiting for your hearing or trial, this time will count against your total time to serve.
  • If you are OUT on Bond; then it will NOT be counted as Time Served ...
