  • Define enforce. If you simply mean do they have the right to request such information, the HOA covenants should specify that they do require it. They have good reasons for requiring this information if they do ask for it. I lived in a community once that did in fact, per the covenants, require it. They wanted the following: -Driver's license number -Driver name -License plate number -Make, model, color, year of vehicle for each resident A good example of why this came in handy was when a minivan at the complex had an alarm that malfunctioned starting at 7:00 AM. Numerous residents reported it and the HOA folks were having a devil of a time figuring out who owned it. The HOA/Manager made every effort figure out who owned it. They asked everybody in the closest units if they knew which condo the owner lived in. Nobody knew. This took HOURS and it was still going off at 12:30 PM when I arrived home for lunch. They really hated to call the cops on residents, but other residents were angry and had called citing a disturbance of the peace. The cops showed up and talked with the manager and asked what info. he could provide--he had nothing. So the cops had to run the plates, link it to a registered owner, and attempt to contact the owner before towing it. The owner was not a resident per the files. The van was towed (thank goodness). To end this lengthy saga. The condo owner had moved his Dad in with him and the van belonged to the Dad who carpooled to work with his son. If they had reported a new resident and resgistered the van, it would have saved a lot of people a lot of time and splitting headaches. The upshot is, the son (condo unit owner) then threatened to sue the HOA for towing his Dad's minivan. He went nowhere with it and they did a mass request for everybody's updated vehicle registration info as a result. They do have good reasons for asking that this information be provided. What they can do if you fail to comply? Depends on the laws where you live and what the HOA covenants state. Hope this helped though :)
