Sexual Consent in Indiana In Indiana, I do not believe it is illegal for an 18-year-old to date a 16-year-old. However, I believe the 18-year-old could get in lots of trouble over having sex with a 16-year-old if anyone pushed the issue. If the state law officers found out about it, they would have the autority to arrest said 18-year-old for child molestation. Of course, that is up to the parent/guardian of said 16-year-old, depending on if they wish to press charges. ***These answers are wrong, it is legal for an 18 year old to have sex with a 16 year old, as of July 1, 2007. The law was changed to allow a person who is under 21 to have sex with a person as young as 14, as long as there is no more than a 4 year age difference between the two, and as long as they are in a dating relationship.
