DOD Directive 1348.20 (36 U.S.C. 179-182), authorizes a "service flag" saying that you have a relative serving in the U.S. Army. Can such a flag be made for a character in a play to indicate the same for that character, without incurring the $1,000 fine?

    USC Title 36, Chapter 10 (Patriotic Customs) encompasses Sections 171-182. This section is commonly referred to as the Flag Code and sets out the rules governing the display and use of the National Colors as well as the Service Flag you mention.

    The US Code does not assign a penalty or fine for violation of 36 USC 171-182, so the $1,000 fine you mention may be a state penalty.

    A casual search of flag makers shows that none of them will make a Service Flag for a customer without proof from DoD that the customer is qualified. Proof can consist of deployment orders or death certificates.

    Feel free to make one on your own and use it in a dramatic production. I doubt that you will get hit on it.
