I have a Provisional drivers license in Maryland today I received a reckless driving offense. I did not receive a ticket I have to go to court for going 95 in a 55 mile zone. With my Provisional license what advice would you give me?I don't want points

    You are lucky - if you had got caught in the UK that much over the limit you would probably have been banned.
    I dont know the law where you are, but at a guess all you can do is beg for mercy and appologise like mad. You could try and book yourself on a safety class - to show you take it seriously and hope the judge might therefore be lenient.

    You're getting points. 95 in a 55.

    You're lucky you're not in jail. Georgia cops have the option of carting your butt off in that situation.

    Your only hope is to get the case dismissed. You will go to court. Remember, you do not have to prove yourself innocent. They have to prove your guilt.
    Either get a lawyer (I highly suggest you get a lawyer!) or call the court and ask them how you file a request for the following:

    1)the cop's training records -- your argument is that he/she may not have been properly trained to pull you over or maybe not even qualified to be on the road (even experienced cops will blow off training and technically can not do some things such as traffic stops or even carry their pistol)

    2)The complete calibration history of the speed gun (whatever they used to check your speed) -- it may have a history of not being calibrated properly or not recently. In that case, you may gain some reasonable doubt.

    3)You had to have received some sort of citation. Read it. Is there ANYTHING wrong with it? Hope there is.

    4) Ask for the cop's arrest history. Look for any reckless driving charges. Is she/he pulling over a lot of people for reckless driving? The cop's definition of reckless driving may be different than the state's.

    Get a continuance on the court date. You can delay it once in most states for no good reason. If asked for a reason, state you need time to obtain evidence.

    You hope is that either the state/county does not obtain the materials requested or the cop does not show up to court (that is why you get the continuance - screw with the cop's schedule).
    If the county does not give you the materials in a timely fashion, tell the judge you did not access to the requested materials and the judge will, most likely, dismiss the case.

    Dress nicely for court. Dress like the judge or lawyer will dress. If that means borrowing clothes, then do it.

    I am 14 for 24 when it comes to getting out of traffic tickets. I have used any or all of these tricks. I went to court on a stop sign violation 2 years after I got the ticket and the cop had quit the force and it was dismissed due to lack of evidence.

    In Maryland, I'm suprised you still have you're license. They love to take licenses away in Maryland. At least pretend to drive like a sane person in the future and you'll be fine.

    Virginia is tough on traffic violations, but Reckless driving is a misdemeanor criminal offense in our state. You're going to get points on your license, and you're going to have your license suspended for at least six months. Lucky for you this happened quite some time ago, or else you'd now also be paying an exhorbitant fine to help finance the DOT's road repairs =)

    Slow the hell down...you'll probably have to attend a safe driving school to withhold points. Ask them to withhold adjuncation and do whnt they tell you as far as safety classes.
