I am 16 years old with a 4 month old baby. Can I sue my ex boy friend who is 19 for child support?

    Yes you definitely can sue your ex boyfriend. Such a case is often referred to as statutory rape. As per the law, the age of consent for teenagers is 18 and the statutory age for adult is 24 years. Since both of you are under age. both of you would be called in questions. Consult with a lawyer or an adult in your family who have a better perspective about things such as this.

    You can also put him in jail. You're way under the legal age. What are your parents doing? Besides Statutory Rape if he is and he concedes to be the father, sure you can collect. I assume you are at home with your parents. That young man can be in serious trouble with the law. If he's not in jail, going through the Civil Court system, he can be ordered to pay child support. It will be based on what he makes.

    Yes you can. You will want to look up the laws in your state both on child support and visitation rights. If you want the money and don't want him to have vitiation than that may be difficult. If he will have visitation rights you may not want to put him in jail. Think into the future of what will affect both you and your child.

    Listen, Everyone on here is saying "statutory rape". Cop out. Was it consensual? If so, it's not statutory rape. I am sorry I don't care what the book says. A female should never ever try to get one over on somebody just because the law says you can. You knew what you were getting into. Second. Yes, you can sue him for child support. He is of age to legally be obligated to pay out. Personally though, the way i feel about "Child support" and "Baby momma and baby daddy" drama is this... I have no kids but if i did and it ever did happen where we weren't to be together anymore, i wouldn't dare ask for a single cent. When my child is with me I will support my child. (Clothes, diapers, formula, ect.) When the child is with the father he should pay for all of that for his use when the baby is with him. If it is a situation where the baby's father is not in the picture, why would you ask for it anyway?

    The father of your child can be made to support the child regardless of his age. If there is any question about whether he is the father the court will order genetic testing. Go and talk to a domestic law attorney. If you can't afford one, call the bar association in your state for assistance finding counsel (I mention this as I do not know your circumstances). I will also mention that once you get the order for child support, and the child's father begins to earn more money as the years go by, you can always go back to adjust the amount of support based on what is called change of circumstances, meaning the father is earning more so should pay more support. Many people don't realize that the child support amount is only fixed until there is a change in circumstances --- but it's not automatic, you have to file for it. Your attorney will explain how it works in your state.
