I would suggest you find An Enrolled Agent who can give you the answers you need and/or file your 2009 tax return.
There are several unasked questions here: do you work outside the home? If no, then filing married is the best. If yes, then you can always file the form for 'injured spouse' when you file and you should get your share of the refund. The major problem with married filing separately is that if he itemizes, since he has the house, you will also have to itemize even if you have nothing to itemize! In other words you will not even get a standard deduction if your spouse itemizes, which he more than likely will since he owns a home. And if you are contributing to that home, you are entitled to whatever percentage of the interest/property you are paying of the home.
You really do need to see a tax professional to help you thru this mud puddle!

You need to figure it both ways. Separate and Joint and go the cheapest way (fewest cost in taxes).
However since you mention taxes he is paying previous to you being married, that needs to be considered also.
If that is small, paying it off may be in your best interest (could save a lot of interest).
If you can't and he is stuck with a monthly or yearly payment on back taxes, that may stand alone and you still figure the cheapest way anyway.

I can't get co-operation from my husband to sign the amended return we filed when we were married. What can I do ..we owe money ..how can I pay for just my portion with my signature..can I let the IRS go after him for the other half?

You're reading I was married in november 08. My husband is still paying on taxes he filed previos to us being married. He bought the house we live in now as well. Should we file jointly or seperately? Please help. This is all very new to me
