My mother fell down my deck about 10 yrs. ago. My home-owner's insurance paid for it and absolutely no questions were asked.
Since laws vary world wide, consult either a local lawyer, or go to your local library and read the local law books ...
It is not their fault that you fell, don't look at is an opportunity to get rich. If you hurt yourself, turn it in to your health insurance and pay the rest.
Is it wrong to attain an attorney to make the person who totaled ur car,... pay for damages?

Can I refile a claim if at first I did not claim Workmans Comp and it happened on the job? My employer said to file with Workmans Comp.

Thanks. You didn't mention any injuries or where you are. That affects the answer.
Also insurance is irrelevant as the owner/tenant is liable - insurance coverage to help them meet their liability is their problem not yours.
