I know someone who got locked in the cemetary whilst tending a grave, so he sawed the chain off, put a new one there , drove off and left a note explaining - is that a crime?

I don't think so. He was not trespassing. His intentions were good since he replaced the chain. What else was he supposed to do? He needed to get out and maybe could not jump the fence or fence too high. If it were me, I would go talk to them the next day. Even if they filed charges, I don't think it will hold in court.
