  • if his name isnt on the tenancy you cant get into trouble for kicking him out and changing the locks because its your house. you can even call the police and have him removed from the house if it got so bad that he wouldnt go
  • IF his name is on the mortgage or lease ; yes ..you COULD get into trouble ... You need to get in touch with a DIVORCE attorney ASAP to protect yourself ...
  • Yes you can get into trouble, it is his house just as much as yours, unless he is a threat to you, then you need to get a restraining order. He can simply break a window to get in.
  • Go to a lawyer and get a legal seperation first. Then toss the bum out.
  • Magic 8 Ball says...ummm quite assuredly YES... When some one RESIDES at a location, receives their mail at the location, you can not simply put their stuff out and change the locks. As mentioned, you need to go see an Attorney first off. If he is abusive, you need to seek a restraining order and a kick-out order. IF he is PHYSICALLY ABUSIVE...DO NOT ASSUME THAT THE RESTRAINING ORDER IS GOING TO PROTECT YOU. There are a number of dead women, who all had restraining orders in their possession. YOU BEING SAFE IS THE NUMBER ONE PRIORITY HERE! Things can be replaced...you hurt or dead can not be turned around once it has occurred. BE SAFE first and foremost! If he has been physically violet or threatened you with harm...even if you have a restraining order...LEAVE the house and go someplace he can't easily locate you. If he is just annoying enough to piss off the Pope and you feel you are done with it, then speak to your attorney about the best course of action. If you both own the house you live in, then steps must be taken and you may not just expect him to leave, unless he is a threat to you. You may have to "put up with each other" for a while as things are being done to end the marriage. Good luck...STAY SAFE.
  • Just because you want your husband to move out, doesn't mean you have the legal right to make him move out. He most likely has the same rights to the property as you do, unless he has been abusive and you call the police and press charges. If you put his stuff out and change the locks he can sue you for an illegal eviction. Go visit a divorce attorney and find out how to get him out legally. Chances are, if you want to get away from him that bad, you may be the one moving.
