By doing a business-name search with your Secretary of State
Check with your Secretary of State or whichever department issues liceses to do business in your state. They will maintain a list of every business that is licensed to do business.
In the UK go to: http://www.ipo.gov.uk/tm.htm
or check companies house: http://www.companieshouse.gov.uk/
First, do a Google search for it. If that comes up clean the definitive test is to file a trademark or service mark application with The United States Patent and Trademark Office.
Bear in mind that names using common words may be unused, but they still won't pass muster with the USPTO if some other business in a remotely similar endeavor uses the same common English word.
There must be a Government department that takes Business Name registrations, another thing to consider may be a web address as well, people register domain names even though they will never use them in the eventuality that a business decides it wants to and then has to pay to gets the rights. I'm not sure of the site but if you searched in google I'm sure the address will come straight up.
