Help answer this question below.

My mother died about 20 yrs. ago. She left the house to my 2 sisters & I. For the past 20 yrs I have lived in the house & paid all mort,taxes,ins,repairs.One sis now wants to cash out & get a third. Can I legaly give her less? She feels its her fair share

    Get a lawyer. If she put nothing into the house, I would argue she should only get one third of what the house was worth 20 years ago. Good luck.

    The only thing you may be able to deduct is, if the mortgage is in all three names, then you can deduct 1/3 of what you have paid there. The rest is what you pay for the right to live there. This is what we were told on ours. Consult a lawyer.

    Obviously any money spent on major improvements should be deducted when valuing the property. Apart from this she's pretty much legally entitled to a third. Although you've been paying the expenses of the property you've received the benefit of living there. Argueably if you want to deduct expenses then you owe her and your other sister 20 years of rent. I know you'll think it's unfair but she probably thinks she's done you a huge favour by not cashing out for all these years.

    Tell her you will be deducting one third of all mortgage and maintenance costs and if there is anything left it's hers, or she might actually owe money.
