Can you be charged with retail theft if not caught in the act but by a person saying that you a stolen something from their?

    If they recovered the merchandise from your body, then of course they can. But most places have a policy where the loss prevention associate has to see you on camera conceal the merch, and pass the last point of sale. So I would at least go to court to see what they have on you, if no camera evidence, then I'd say fight it.
