My husband recently passed away and I was beneficiary on his life insurance but not his 401k. I thought I was. Before we entered into a marital relationship his mother was listed as beneficiary and she inherited the 401k. Do I have ant legal

    Do this:
    check the will for beneficiary names.
    then check the designated beneficiary with your husband's employer - the last company to hold the 401K.
    The employer should have some kind of phone number of who to call when the employee dies.
    If the beneficiary names are not the same in both places (the will, and on the 401K account), you actually have a snowball's chance in hell.

    If the beneficiary name is same in both places - well, then you are pretty much SOL. You can hire an attorney, but he probably won't work for you unless you pay upfront. Is that enough of a hint as to how big a chance you have at winning?
