Can my daughter take the fifth amendment in a case against me

    The entire idea behind the 5th is to prevent you from testifying against yourself, not someone else. So unless there is a reasonable way for her to be guilty of a crime in her answer, she'll be asked to testify. And if they want you badly enough, the prosicutor can give her immunity to anything she'd say about herself, and then the 5th doesn't apply.
