I'm 18, she's 16, and she wants to have sex. If she initiates things, is it illegal?

    Many states do set the age of consent at 16. That means that you two can legally have sex (barring any other laws) if you live in one of those states. If the age of consent is higher than that (or if she was younger than 16), then it does not matter who initiates. The laws basically say that below a certain age she does not have the legal capacity to consent whatever she might actually want, making sex with her (legally) a case of rape.

    Although this is not legal advice, as I have no license to practice, most US states set the age of consent at 16, which would make it legal for a man and a woman to have intercourse. This does not, however, exempt you from a myriad of other laws that may be on the books in your state, such as contributing to the delenquency of a minor. A good place to look for some basic information is here, and afterwords, you should check your states government website for a list of their revised code.
