  • You should be allowed to punch in upon arrival After you put away your coat, purse, hats etc ... and THEN ; he could require you to be there a few minutes early ... He is not allowed to ask you to be there IF he is not going to pay you ...

  • I'm not sure about that but I think that would piss me off, LOL! I use to take MetroNorth to work every morning and I would arrive at my job at 8:35 every morning. They told me I could take 5 minutes less for lunch which I did every day. Another company purchased us and my boss (who by the way never, ever made it on time) told the new owners that I couldn't get there by 8:30 so they changed my hours to start at 9:00 instead and I made less money because I worked 4 1/2 hours a week less! I was so pissed that when I got there at 8:35 I refused to do a damn thing and when my boss got an attitude, I said "remember when you told them that I can't make it here by 8:30 so they changed my time to start at 9:00? I'll be starting work, when I start getting paid. And that was what I did for all the years I worked there until I moved where I live now! And BTW, after I moved and they realized she was late every day sometimes not showing up til noon!, they demoted then fired her.
  • Not legal in the U.S., but if you are non-union, you can be fired for almost anything. Difficult situation.

  • We had a problem here with that, they wanted us to do an end of shift report 15 minutes before we clocked in with the security guard we were relieving, they even wanted to write us up if we didn't do this and we got that knocked down due to the fact that they were requiring us to work about 55 hours a year for free, for me that would be about $400 in free labor a year
  • I don't think it is legal. If you are scheduled at 9am than that's when you need to be there...if he wants you there at 8:45 than he needs to schedule you for that. And he should plan all his meetings accordingly. At my company staff meetings are planned, we come early and we are paid for the extra time. If he isn't allowing you to clock in than there is no point for you to be there early, unless you choose to be at work early.
