There isn't enough room in jail. Nothing is going to stop people from having sex. Separation of Church and State. The Bible says pre-marital sex is wrong, but you can tell from looking at this site, there are a lot more atheists than I thought. You can't base a law on a religious belief not not followed by everyone.
