Can my income be considered when my husbands ex wants more spousal maintenance? He lost his job just after we got married 2 years ago now has a job making less $ judge lowered maintenance payments, she wants more $ after losing her job.

  • That depends on the jurisdiction where you live.
    If he got his payments lowered due to changed circumstances, it's only right that she have the same recourse.
    Are there any children involved? I notice that you use the words 'spousal maintenance'; in North America, the usual terms are 'alimony' or 'spousal support.' Are you in the UK, by any chance?

    Unfortunately, YES, your income can be considered because that is more income coming into the household that can support the household which then 'frees' up more of your hubby's income. Went thru this many,many years ago when my husband's first took us back to court for more support, only I had a brand new baby and was on a leave of absence, so had NO income at the time! stupid move on her part...but, then, stupid is as stupid does!
