  • The best way: show 8x10 glossy photographs of the stop sign obscured by trees, and testify that no one could possibly see the sign in time to stop and on the day in question you certainly didn't. Bring witnesses, for example, a neighbor (not related to you) to testify that she has repeatedly called the city to complain about the obscured sign. Hope that the cop doesn't show up for the trial. Short of that, you're probably out of luck. A cop on traffic detail who is posted at a particular intersection to observe whether a car's wheels come to a complete stop will generally prevail over a driver (an interested party, after all, and therefore biased) who says, "I know I stopped." In California this is a point violation. If you're eligible, going to traffic school will mask the point on your DMV record.
  • Unless you have a witness, that was onboard your vehicle at the time of the violation, you will not win in court. just think of the many other stop signs that your ran, that you were never cited for. time to pay the piper. go to court and do your four hours of defensive driving school.
  • If it was recorded on the dash cam (all of the newer cams I have seen have options to record for X number of seconds before the lights are activated or to record all the time) and it shows that you did a "California roll" or just comple tely blew the sign that was in plain view then you can't fight it unless you want to pay extra and still lose.
  • Was it issued incorrectly? In other words, *did* you stop at the sign? If not, then you were driving dangerously, and you should pay the fine with good grace and think about the way you drive.
