Can a 13yr old choose whether or not she wants to visit her biological father in another state if there is a current visitation order in his state of residency and the 13yr old and her mother have been a resident of a different state for over

    I have read that at 12 years old a childs "wishes" would most often be granted by a court.

    Legally the 13 uear old is not of age to speak for themself so the visitation order does have to be followed but what you could do is file for modification of visitation in the state the case was originall held in or open a new case in you current state. if you were to open a new case in you current state i suggest that you have a lawyer handle the linguistics of tansfer of venue but it is very doable.
