Ok we were renting our house from month to month then we rented it from wek to week. The tenant paid good for two weeks but now he isnt p-aying out all, We were wondering how much of a notice do have to give him to get out? He will not talk to us.

    Give them a "Demand for Rent and Notice to Quit." The Demand for Rent states what amount is due to be paid within 7 days or a they must "quit" the premises. Once they pass the 7 days, do not accept partial payments from them or you will have start the whole eviction process again... Just file the eviction notice with the court and have them served. They are trying to avoid you to see how long you will let them stay without paying. They may have done this before. Don't wait get the process started asap.

    Check with your local courts to see what language is required for these notices. You may also be allowed to ask for additional damages.
