  • That depends on where you live. Some countries have a written, or assumed constitution, that lays out what are accepted as basic human rights in that country (or Union). Other countries have a different form of government, and they might decide what is a basic human right for their people. Coldwar CCCP had a very different view on some basic human rights to, say, USA. So, to answer your question, your present, or past, government, usually through a constitution, decides what is your right and what is a privilege.
