My brother was charged with fourth degree assault after he tried to take his daughter's cell phone and she was scratched(he didn't even know it). He was released from jail by judge for no money. What is his possible sentence for 1st of

    he needs a good criminal defense lawyer, quick!! if this event is as simple and straight forward as you make it sound (and it probably isn't) he doesn't want to carry a conviction around on his record for the rest of his life.


    btw if the child he 'scratched' is underage he's probably had to sign her service contract, he should have just made a phone call and had the phone turned off for a few days. if she is an adult, he was OUT OF LINE trying to take her phone, anyway!
