  • Are these delinquent accounts a result of homes being foreclosed on? If so, yes they can unfortunately but it has to pass a homeowners vote. Soemtimes however the HOA can exercise their power if they deem this increase to be an emergency measure. If however the delinquent accounts are a result of non payment or collection, then they can't do this. This basically means that you have a very inefficient HOA and Management and should be removed.They can not pass on the cost of their mismanagement to others..it's FRAUD
  • There are times when circumstances will cause the dues to be raised especially in this economy. There could be a high foreclosure rate in your community, which means, until these units are sold there are no dues comming in, or there is a high delinquency or collection rate and an attorney may be hired to enforce collection efforts because your neighbors just aren't paying their dues. There is a good chance that your HOA is doing everything they can to maintain the intergrity of the community. Which would not necessarily make them inefficient.
