Help answer this question below.

Hello, my wife and I are currently in a chapter 13, she
currently has 40,000 dollars in her 401k.. We need $9,500
to come out of the chapter 13 and get our finances and lives
back on track.. Can we withdraw $9,500 from her 401k plan
to do this?

    File chapter 11 and then go back to chapter 1

    You should check out Prosper.com. You may be able to get a loan from private investors to cover that much, without robbing your 401k and having to pay the penalties!

    You should be able to, 401(k) accounts allow for hardship withdrawals.
