Help answer this question below.

My husband injured his back at work and now they are saying they are going to deny his claim because they know he has had back problems before(which is not true, other than straining it), can they do this?

    It depends on where you are, how the accident happened and many other factors. the 1st thing I would establish is that he has never had any real back problems before. If he has never recieved treatment for a back problem in the past that would argue in his favour.

    I he has been treated previously and the doctor said it was a minor thing (a strain) that would argue in his favour as well.

    Is he unionized? If so they will likely have an advocate (someone versed in dealing with worker's comp) to assist him. If he is not unionized then, at least in my province, there is a government-funded agency for the sole purpose of assisting people with Workers' Comp problems.

    Give more info (state/province, union (which one) or non-union) and I can maybe help a bit more.
