  • Why? 1. Because they are supposed to be a religious organization. Here in the US where we value the separation of church and state, churches should not try to alter STATE legislation. 2. Because they collectively gave over $20 million to the effort to write discrimination into the CA state constitution. And most of that money came from OUTSIDE of California. 3. Because they helped spread lies about equality by paying for the terrible ads that the "Yes on 8" people distributed, including an incredibly misleading flyer about Obama supporting Prop 8, when he said exactly the opposite. Those are plenty enough reasons for me.
  • Because they are a large single target. And because it looks like an outside entity is influencing California's laws. Most of what CurtisAndWilbur has said is true. Churches are free to engage in any political activity. However, considering the massive effort that the church put into this political drive, I don't think it is fair for the taxpayers to have to shoulder the tax burden that the LDS, as a non-political 501(c)(3) corporation, is exempted from. Also, the YES ON 8 ads did not, strictly speaking, tell any lies. They were, however, misleading, using irrelevant events from other states to spread Fear, Uncertainty, and Doubt among those California voters who did not have sufficient time to properly educate themselves on the issues. It doesn't really matter. Since prop 8 is in conflict with preexisting rights in the constitution, it is therefore a "revision", not an "amendment", of the California constitution and as such it requires a 2/3's vote by the legislature before it can be considered valid.
  • Are you saying that procedural laws can not be challenged on a constitutional basis? A federal law permitting search without a warrant it not subject to Due Process scrutiny? The courts can still apply Rational-Basis scrutiny to sexual orientation cases. Lawrence v. Texas, 539 U.S. 558 (2003). What is the rational basis for a federal law preventing the government from recognizing same-sex marriages?
