  • That's up to you. However, unless he either gives up legal rights to the child or you have them removed from him, he is entitled to everything else that a father is entitled to. This includes visitation or even custody. Be aware, though, that it's not easy to remove his legal rights to the child if he is the biological father. Judges are EXTREMELY reluctant to do so outside certain extenuating circumstances. Their viewpoint is for the welfare of the child and financial responsibilities for the care of the child is part of that. And your case doesn't sound close to one which would justify this. Which means you might as well take him to court for child support. And by the way, have it set up so that he pays the court clerk and not you. This way there is no question as to records of him making or missing any payments as they will keep all those records.
