  • The border patrol has no authority outside the USA, thus cannot pursue or fire back across the border in retaliation..That would constitute a sort of war.Two US border guards are spending many years in prison for overstepping their bounds so the rest will not follow suit.Why should they risk prison time?

  • In a real scenario like this Mexican government would arrest the sniper, and do whatever the US wanted to do with them. Either put them in a Mexican jail, or turn them over to the US. In the theoretical situation where the Mexican government is real stupid, and refuses to do anything about it, or were actually responsible, it would be considered an act of war. And of course the US would win that war within about an hour.
  • This question is possibly the answer to 'How can I get tossed into Guantanamo'..... My understanding of juridictional restraints would make me think there would be little we could do, considering we arent authorized to apprehend criminals over the border. The best the BP could hope for in that scenario would be swift response from Mexican law enforcement. After that, extradition comes into play...
  • Patrol Agents would fire back in defense of their life. If the agent was killed and the sniper fled successfully, he would most likely get away with it. Even if the Mexican government did apprehend and arrest the sniper, the Mexican government would refuse to extradite the sniper to the United States because of our death penalty laws that the Mexican government abhors. Maybe if the United States agreed to pursue a sentence of life in prison, perhaps the Mexican government would extradite. This doesn't seem like justice for the family of the agent killed in the line of duty however. This is all theoretical and the corrupt Mexican government would probably be unable or unwilling to apprehend the sniper. The Mexican government is unable to keep its own cities safe (see Tijuana, which averaged about 3 deaths a day last year and has an ongoing war between drug cartels, murder of Calexico police chief)
