  • It depends on the state and whether it's for a felony or a misdemeanor. For example, in California, they have up to a year to file a misdemeanor and up to 3 years on a felony. There is no statute of limitations on murder or crimes where the punishment is life in prison.   • A DA dos not press charges. The DA files charges. And the charges will be filed before you are arrested, or immediately after. You will be informed of the charges at the arraignment which will happen within 48 hours (or 92 hours if there is good cause for it).
