The first step is the parents need to be adjudicated "unfit." The Supreme Court as held that it is a constitutional right of a parent to control the upbringing of their child. This right can only be overcome if a parent is unfit to parent.
Being "unfit" is a difficult measure. For example, if you are homeless, living in your car, and only feeding your child fast food for every meal, you are a "fit" parent.
Once a parent is deemed unfit, then you can apply for custody.
First they hire a good attorney. Then he has to find proof that the parents are not able to raise the children in a decent ,healthy home and should be in the care of the grand parents where they will be safer and better off than with their own parents.
It's not easy to do, unless the parents agree to the transfer of the children to the grand parents....but dont give up...it's for the judge to decide where the children will be the best cared for and if the children want to be with the grand parents its a much better change of winning.
