Child support is not based on the other parents income. If you were independently wealthy you would get the same child support as if you were making minimum wage.
It does matter what the other parents income is in some states. New mexico forced a modification of my order due to the fact that the other state wouldnt respond with what the cp's income was. Why would they even ask if it didnt matter? Dont answer questions if you dont know the answer. It makes you look stupid.
Before I give you my answer, it is helpful if people asking questions on this website would please tell us which state you are living in because the rules vary from state to state. That being said, in Virginia the child support guidelines provide a formula for calculating child support based on a proportion of both parents' gross incomes. These guidelines are applied unless a party can show that application of the guidelines would be unjust and inappropriate in a particular case. what you are describing may be legal, but it's not very nice.
it doesn't work that way. the support amount is done by the gross amount that the non custodial parent earns. if the custodial parent income is reduced, that has no bearing on the amount the non custodial parent earns and they continue to pay the amount. the custodial parent can ask to have the amount raised, but normally it will not be raised since most child support is done by a percentage, and by law can't go over the percentage of gross income. In other words, you can't demand the entire check for child support, the constitution gives us the right to life, liberty, and the pursuit of happiness, and by taking all of a persons income, you deny them that right.
Ex doesn't pay full amount of child support, sometimes not at all. I contact Domestic Relations monthly, nothing happens. What can I do?

No. Child support is based on each individual parents income and the percentage of custody of that parent. The other parents income has no effect whatsoever on what is owed.

You may be thinking of alimony, in which relative income disparity matters. But your child support obligation is determined solely by YOUR income and YOUR percentage of custody, or lack thereof. This is because the law recognizes that a child has the right to share in the wealth of both parents, even if one parent makes much more money than the other.

I think my law degree and my license to practice law pretty much covers that. Again, child support is based on YOUR INCOME and YOUR PERCENTAGE OF CUSTODY. The law does not allow one parent to avoid paying support just because the other parent makes more money.

Keep telling yourself that, but it is not going to make it any more correct. No state lets a parent off just because the other parent makes more money. Your support is determined by two factors: 1) your income, and 2) your percentage of custody. Out of curiosity, what state do you claim lets a parent avoid child support on the basis that the other parent makes more money?

I'm not claiming anything, I'm telling the facts about Child support here in CA. It is based on both parents income and the percentage each parent has him. My husband and his ex have gone to court serveral times for custody/child support. (And yes this is only child support not alimony they were never married).
My Husband EX
1. CP-90% NCP-10%
$450 to NCP
2. NCP-35% CP-65%
$900 to CP
My husbands ex has never had to pay a cent to my husband even when he had cusotdy and was the CP.

I think it depends on the state. Here in CT I filed for child support and yes they said it was based on both our incomes. I had to tell them how much I made, how much, in rent, cloths groceries etc. They said it is based on what we are both making not just him.
