Is it legal for a parent receiving child support to willing cut back their hours at work in order to receive lower pay and get more child support?

    Child support is not based on the other parents income. If you were independently wealthy you would get the same child support as if you were making minimum wage.

    It does matter what the other parents income is in some states. New mexico forced a modification of my order due to the fact that the other state wouldnt respond with what the cp's income was. Why would they even ask if it didnt matter? Dont answer questions if you dont know the answer. It makes you look stupid.

    Before I give you my answer, it is helpful if people asking questions on this website would please tell us which state you are living in because the rules vary from state to state. That being said, in Virginia the child support guidelines provide a formula for calculating child support based on a proportion of both parents' gross incomes. These guidelines are applied unless a party can show that application of the guidelines would be unjust and inappropriate in a particular case.     it doesn't work that way. the support amount is done by the gross amount that the non custodial parent earns. if the custodial parent income is reduced, that has no bearing on the amount the non custodial parent earns and they continue to pay the amount. the custodial parent can ask to have the amount raised, but normally it will not be raised since most child support is done by a percentage, and by law can't go over the percentage of gross income. In other words, you can't demand the entire check for child support, the constitution gives us the right to life, liberty, and the pursuit of happiness, and by taking all of a persons income, you deny them that right.
