Is Solaris open-source - well right now - No.
Will it become open source - almost definately.
Sun released a big chunk of the Solaris 10 source to the open-source community - all the stuff to do with dtrace - their dynamic tracing capability, which with the possible exception of containers is the best part of solaris 10.
So it looks like Solaris soon will be open source

Frankly, I dont know what parts of Solaris are opensource or how far they(Sun people) have gone to open source Solaris. But I definitely know that Sun has taken initiative to opensource Solaris. I have heard that there are some legal bindings also, mainly to SCO. Rather take a look at this news snippet.

    http://news.com.com/Sun+warms+to+open+source+for+Solaris/2100-7344_3-5224473.html?tag=nl

It has headline : Sun warms to open source for Solaris
