Being black (or any color) does not lead to injury or more injury during an accident. Being gay (Or any sexual orientation) does not lead to more injury during an accident. Being Christian (or any religion) doesn't either. Being overweight can lead to more injury in an accident. Mass (weight) adds to most problems. Its not discrimination if it is put forward as a medical/science problem.

If it honestly could be caused by weight it's not discrimination. If I got injured while drunk and someone said the injury was caused because I was drunk... well... quite possibly it was.

People throw around the word "discrimination" way to often in America. The fact is that we "discriminate" everyday. When I hire someone with more work experience as opposed to less, I am discriminating. When I hire someone with a degree as opposed to no degree, I am discriminating. When I hire someone who is licensed in the industry, as opposed to someone who is not, I am discriminating. When I fire someone for poor work experience, and don;t my good workers, I am discriminating. There is nothing wrong with discrimination in most cases. The only time discrimination is "bad" is when we discriminate on an irrelevant basis. However, based on the facts you provided, this is not discrimination. This is simply an issue of causation.

I asked the question and my being hurt was because i picked up a box that was to heavy and dropped it on contact,but because i'm big they are using that as a problem when several doctors have said my job duties were the cause of my injuries. Maybe i should have made that more clear when i asked the question.I don't throw around the race card or any other card for that reason.

To me depends on the injury. If it was a lower back, or knee, or something that extra weight could make worse, then, well, there you are.

Yes, it is discrimination, but it's also just a legal trick to try to get out of paying the full amount. They have dozens of these kinds of technical terms they use to deny benefits.

cause of injury = dropping box reason for dropping box = too heavy immediate cause? Job duties were outlined upon hiring. They hired you and accepted the responsibility and therefore the liability. Only offering an opinion, I'm not a lawyer nor an employer.
