Answer to:
Do i need to answer this entry of default? what form do i need? i did answered unlawful detainer summon.
If an entry of default has been entered, it's probably too late to answer. If you answered the unlawful detainer in the time alloted, a default should not have been entered. An attorney could tell you for certain what's going on. Laws differ from state to state, so a local attorney is your best bet. Good luck.
Answer to:
Could I go to a court house and ask to speak to a judge about my problem?
A judge is not allowed to practice law. If you have a legal problem, see an attorney. A judge probably would not talk to you about a legal matter because all parties have to be present for all meetings. You might want to ask an attorney for a consultation. It won't cost as much as actually hiring him/her to represent you and you can find out what options you have. Good luck.

Answer to:
Is it possible to change a divorce settlement after divorce is final, if you think your spouse did not fully disclose their assets?
A final divorce is basically a court order. Any court order can be changed if the judge can be persuaded that the original order needs to be changed. To do this, the case must be brought back to court to ask for a modification. You'll need to consult an attorney, not necessarily the attorney that assisted you in the past. Good luck.

My fiance is owed thousands of $'s in child support. But she only pays when she wants too. However it's supposed to be payed every month. We are looking into getting the money garnished. What can we do to prepare for that? keep receipts?a journal?....?
I'm a little confused. Is your fiance' the one receiving the payments or the one paying? If your fiance' is the one receiving payments, then, yes, you should keep all receipts and keep a journal of all payments. If you are successful in getting a garnishment or a child support withholding order in place, the money will be taken out of her paycheck (assuming she's employed...

Answer to:
If you were a lawyer, would you only take on clients you agreed or sympathized with? Or would you take on any client no matter what they'd done?
Even though we would love to believe that lawyers are somehow above working for money and only working for a just cause, they do have to make a living. Making a living in the legal field means taking on cases that will pay the bills. Once an attorney has been practicing for a number of years and has a good client base, it may be possible to be a little choosier about the clientele.

I rented a condo that was supposed to be cleaned and painted but was not. it also had mold, i could never move in, and the rental company let me break the lease but i want the rent i paid back ($6,300).
how hard is it to go to small claims court.
It's usually just a matter of filling out a form and paying the filing fee. In the State of Alabama, the most you can sue for in Small Claims is $3,000.00. If you want to just sue for $3,000.00, you can, but you couldn't expect to get more than that. Call your county's Small Claims Court to find out the most you can sue for and the filing fee. The rental company will be served...

What is the definition of a third party caregiver for elderly

How do I placing a lien against a bad renter?
To place a lien, you must have a judgment against that person. To get a judgment, you must sue the person in civil court. In this case, you would sue for any back rent that is owed plus court costs.

Answer to:
How is service perfected in a lawsuit. if i was sued and certified mail was sent to my fathers office and he signed the certified mail, has service been perfected. it is not my place of business, i have no ownership in property and he signed his name
States probably vary on this one, but technically if the certified mail was sent to you and was marked restricted, you are the only one who is supposed to sign for it. If someone else signed, you have not been served. If the case makes it to court without you being served, it's a good point to bring up with the judge. I would advise talking to an attorney about representing you in court.
Answer to:
How long do restraining orders last.
A restraining order should state how long it is good for as part of the order. If it does not state a date or does not say "permanent," contact your local law enforcement or the court where the order came from.

Answer to:
What constitutes legal rights to obtain a restraining order in alabama
A restraining order in Alabama is filed in Circuit Court. The attorney filing the paperwork will submit a motion detailing the circumstances of the need for a restraining order. The attorney may also file a motion for an ex parte restraining order, meaning that only one party has offered evidence of this need and that the restraining order is temporary until the hearing date. The judge will...
Answer to:
If you are given a notice of a civil claim from a store for taking an item worth $7, any idea how much they will charge to be compensated? Also, if you usually just pay the claim, they usually dont pursue you any further in court do they?
A civil claim is all about money. If you are sued for $7 and a judgment is entered against you for $7, you would owe the $7 plus any court fees (filing fees, garnishment fees if applicable, etc.) In some states, this would be handled in Small Claims Court where punitive damages are not allowed. If this civil claim is handled in a court that allows punitive damages, you would owe $7 plus...

You will need to check with the Probate Court of your county. Is your daughter a minor? Be sure to ask the Probate Court how to legally change a minor's name. For an adult, it just requires filing a form and paying the filing fee. The Probate Court is the same place where you apply for your drivers license and car tags.

Have you ever seen the inside of a court room?
Yes. I was a court reporter for 7 years and reported many trials and hearings. I've been on Federal jury duty once, but was not picked for a jury. I still work in the court system as a clerk and go into one of our 2 courtrooms for various things as a matter of routine. It's not like you see on TV, although many people are surprised to find this out. It's usually pretty boring.
Answer to:
If a child support order from a trust account was stopped when child moved in with father, is the father again responsible for child support if he sends child back to mother 6 months later?
Child support always stems from the last order that the judge signed. In this question, it appears that the child support order was "stopped." Unless the order stopping the child support had some sort of way for the child support to start again if the child went back to the mother, the order stays "stopped" until a new order is signed by the judge starting it again.

Answer to:
What is the name given to a divorce when it is complete?
Final decree or final judgment of divorce.
Answer to:
If my spouse doesn't respond to the initial 'complaint for divorce', will there be any additional paperwork I'll need to file?
In any civil suit, including divorce, once the period of time to answer has passed, the plaintiff can file an application for default judgment. Certain statements have to be made and sworn to in the application, so check the local law library or a good on-line source for the wording you should use. If you're lucky, you may even find a form you can use.
Answer to:
If a husband files for divorce in the state where both he and his wife lived together, but then the wife moves to another state before the divorce is final, must a divorce be filed again in the state where the wife now lives?
A divorce stays in the state where it was first filed. If the parties agree, the suit could be dropped in the first state and started again in another state. If the parties cannot agree to refile in another state, the party who moved out of state would have to come back for any trial or hearing that may take place.

I'm 13 and I have about 6 grey hairs and 1 is turning grey. Is this normal?
I was 12 when I first discovered I had some grey hair. It was kind of clustered around one temple underneath my dark brown hair. My mother was completely grey at 35, so it can be a family-type thing. Neither of my children, one boy and one girl,...

Is it possible to overfeed your cat so much that she will puke? My cat just up and did it, and she wasn't throwing up hairballs.
Sometimes one of my cats eats quite a bit and then immediately throws up for no apparent reason. I figure she's just eaten too fast or too much. I wouldn't worry about it unless she does it a few times in a row and/or has diarrhea. Then you might want to consider a visit to the vet. Cats can get very sick in a short period of time, so don't delay getting to the vet, just to be on the safe...
Answer to:
What can you do to kittens that will calm them down, and make them more friendly and handleable?
I am assuming these kittens are inside or can be put in a large enclosed area (like a garage or shed). The best way to tame kittens is to spend time with them. If they are afraid of you, simply sit down with some treats, like small pieces of cheese. Roll the treats slowly toward them and just wait for them to investigate and then eat them. Speak softly and sweetly. Don't try to pick them...

Answer to:
In Alabama, what are the penalties for an employer that doesn't cooperate with a child support wage garnishment, and what should the custodial parent do about it?
I don't know the penalties an employer would face for not honoring a child support wage garnishment. The custodial parent should see an attorney to file a notification with the court that the employer is not complying. The judge would probably set a hearing for all parties, including the employer, to attend. The custodial parent, through the attorney, would be expected to show evidence that...
Answer to:
Does the amount of child support someone is to pay decrease as the children get older? If so, at what ages does it decrease?
Child support stays the same unless a judge signs an order changing the amount. Sometimes the custodial parent will file for a modification, or change, in the child support as the children get older because their financial needs increase. Whether or not a judge would agree to a modification is another question entirely. Either parent can file for a modification of child support. You would...

Answer to:
How do I obtain copies of the child support order papers along with the papers describing when and how it got released?
The documents you are describing are part of your court file. You will need to contact the court that the child support papers were filed in. In Alabama, that would be the Circuit Clerk's Office in the county that the papers were filed in. It will probably cost you a few bucks for the copies. Ask for certified copies, even if it costs you a little more. And keep your copy in a safe place....
Answer to:
If an employer receives a court order to garnish wages for child support, how long does the employer have to comply with the order?
In Alabama, an employer has 30 days to start garnishing and must send garnished wages at least once each 30 days. Strictly speaking, a garnishment can be used for back child support. A wage withholding order is used for current child support. A wage withholding order has different rules than a garnishment.

My cat plays with her scratching post and chases the mouse that is attached to it, then she just lies there sorta wrapped around then goes to sleep. Why is this?

Answer to:
I haven't taken my cat outside for over 2 months and she still goes and sits down by the front door and waits for me to take her outside.what can i do to make her stop wanting to go outside?
You are probably never going to be able to convince your cat that she doesn't want to go out. But you can make inside much more desirable for her so that she won't miss outside so much. For instance, be sure she always has food and water, nice places to nap (some cats love boxes to hide in), plenty of toys, and plenty of attention from you. All cats show some interest in the outdoors, so...

Just stay calm when you are around him, no matter what he does (including ripping your lap to shreds). Keep reassuring him in a calm tone that he is all right, that you will keep him safe....

How can I get my kitten to stop biting? Is there a form of punishment that does not involve physical contact?
If your kitten starts to bite while you are petting her face, put your finger in her mouth and tickle the roof4 of her mouth. Cats hate that and will immediately stop biting. You have to be consistent about it and never let your kitten use your hands as a plaything.

I work during the day and my cat was just spayed today. Will my cat be alright by herself until my neighbor can check on her in the afternoon?
Your cat should be all right, baring any complications. It would be best if you had a large cat carrier or box for her to stay in so she won't move around too much for at least a few days. Food, water and litter should be very nearby during this time. If there is any bleeding or discharge from the incision, get her to the vet.

However, the officer who gave you the tickets will be there to testify and explain why he wrote teaneck that way. It is probably a popular abbreviation that the courts would recognize.

Many years ago, I volunteered at a Humane Society, and this is what they taught me: Turn the kitten upside down, look at the base of the tail. If you see two tiny powderpuffs, it's a boy. If you see an upside down exclamation point, it's a girl. Sometimes it's very hard to tell until the kitten is a little older.

Answer to:
What are the major red flags to look out for when viewing homes for sale?
Always look for evidence of water damage on the ceilings. Cracks in the walls is a bad sign, too. Floors that sag are not good. To be absolutely sure, get a home inspection by a licensed inspector. A lot of lending institutions will require one, anyway.

Answer to:
I recently quit smoking. Do I have to tell my health insurance company I am a smoker?
You should answer the question in exactly the way it is asked. If the question is "Do you smoke?", then your answer is "No." If the question is "Have you smoked during the last 12 months?", your answer is "Yes." So just stick to the question and don't volunteer any information, although the insurance company probably knows just what to ask to get...

Answer to:
Are there any restrictions on how I may use the proceeds from my home equity loan?
There are no restrictions on how the proceeds may be used. The only thing the lender is concerned about is that the collateral for the loan (your house) is worth the amount you are borrowing.
Answer to:
Is there a charity that will accept a food gift basket?
If by charity you mean any organization willing to take donations, then I would assume any nursing home or homeless shelter would take a food gift basket.
Answer to:
When is it okay to regift a food gift basket?
I think it's always okay to regift anything, as long as the original gift giver is unlikely to find out. Food seems especially okay because it usually has a much shorter shelf life and will spoil if not used within a reasonable period of time. Other stuff can sit around for awhile before finding itself as a gift to someone else.
Answer to:

Out of respect for someone you know is on a diet, another gift would be more acceptable.

What kind of makeup tricks do health and beauty experts use to make one's face look slimmer?
Put blush or bronzer in the hollow of each cheek (Make a fish face to see where the hollows should be). Be sure to use a back and forth motion to apply it. Dust translucent powder over your makeup to set the look.
Answer to:
What kind of eye shadow colors should I use to bring out my blue eyes? What do the health and beauty magazines suggest?
How lucky you are to have beautiful baby blues! Taupe, gray, violet, or purple look great. If you want your blues eyes to really sparkle, try a blue eye shadow that's a shade or two darker than your eyes. To brighten any shade of blue, try fuschia!

I don't think it's any safer than traditional dating. Each way has its pros and cons. Extreme caution should always be taken when dating new people.

Answer to:
Do I have to tell people that I met my boyfriend on a dating site?
Of course not! If you don't want people to know, just don't mention where you met him. For those that ask, you might want to have an answer ready, like "We met because we were at the same place at the same time." Besides, the meeting place is not important. It's what happens after the meeting that's important. All the best to you and your boyfriend!

What are the best islands to visit on a Hawaiian cruise?
It depends on what you like to do most. Kauai is a great place to go sailing, Oahu is where you'll see the USS Arizona Memorial, you can go biking on Molokai, golfing on Lanai, whale-watching around Maui, or you can visit a live volanco on the big island of Hawaii. So it's up to you!

I've been with my partner for almost seven years and have never had an orgasm with him. Should I tell him, and am I wrong for faking to spare his feelings?
You don't say how old you are, but I suggest a visit to your gynecologist to see if there may be a physical problem. I went for years faking it a lot so I wouldn't hurt my dear, sweet husband's feelings (totally my decision). I went through periods when I had orgasms and then much longer periods when I didn't. When I finally told my doctor, he suggested testosterone....

If someone is using a cell phone in the bathroom stall next to me, is it rude to flush?
It is not rude to do ANYTHING when someone is using a cell phone near you. If a person does not immediately look for a better, more private location or tell the caller he/she will return their call later, he/she is being incredibly insensitive to those around him/her. I was at my doctor's office recently and while the assistant was taking my vital signs, my cell phone rang. The...

At what age should a cat be declawed? Are there alternatives to declawing (I can't be at home 24/7 to catch her and train her not to claw the furniture)?
I know I'm in the minority, but I advocate declawing cats if they will be inside for the rest of their lives. I have had a parade of cats during the last 35 years, and only started keeping them inside and having them declawed after losing 3 cats in 18 months to outside accidents (2 hit by cars, 1 was caught in a car engine). I honestly have not seen any down side to declawing. If a cat...
