*** Your are cuffed and sitting in the back of a cop car.You are the mainsuspect in a shooting. Can the cops look for the gun in your car without your consent or a warrant?
It depends on the circumstances. For instance, say you are in Maryland and your car is in California, the shooting took place 5 minutes ago, and there is no reason to believe any evidence of the shooting will be found in the car. In that situation, the police would need your consent. (No warrant should issue in that circumstance.)
If the police can see a gun through the window of the car...

Can we patent our DNA? I think we can. What do you think?
No. You cannot patent something found in nature. If you somehow altered your DNA in a novel, non-obvious way, then you can patent it, but I assume you haven't done that. The leading case in this area is Diamond v. Chakrabarty, 447 U.S. 303, 206 USPQ 193 (1980).

Who is responsible for determining the President-elect meets the qualifications to be President?
Under the 12th Amendment, Congress is in charge of counting the electoral college votes for President. Under 3 U.S.C. section 15, any objections to the qualifications of the president are the decided by the House of Representatives and the Senate when counting the votes.
It is also possible that the courts could resolve the issue. However, it is more likely that courts would defer to Congress.

Do you need to put a trademark symbol when referring to PowerPoint?
No. The "professionally researched" answer is wrong. Tm symbols are used by trademark owners in order to claim rights in the mark. However, the trademark owner cannot force anyone else to use the symbol.
Even the source cited by the "professional" answer does not purport to require use of the symbol. In fact, it does not even use the symbol itself.

Can Native American Nations copyright/trademark their names? I guess the Cherokee wish they had a piece of every Grand Cherokee....
They could not copyright their names. Copyright applies only to original expression of ideas. There is nothing original about the well-known name of a tribe (e.g. Cherokee).

There are no specific rules about when and how often you have to use the trademark symbol. The TM symbol alerts the public that you are claiming the word as a trademark and puts potential infringers on notice that you claim rights. Both of these are important in obtaining strong trademark rights. You should use a rule of reason. Whenever you use your trademark, it should be clear that you...

A summons usually means you have been sued. If you are so lost that you don't know whether you even have to sign it, for goodness sakes find a lawyer right now! The legal system can chew you up and spit you out over nothing if you fail to jump through the right hoops. If you can't afford a lawyer, search for a legal aid office in your area. In western countries, what is the maximum hours of work allowed per week. I am asking about live in domestic workers, maids etc. , who may not have a set amount of hours wrote on a contract.
In the US, 40 hours is usually a work week. If you work more than 40 hours, you usually get paid time and a half. If you work significantly more, you usually get paid even more.
However, it varies from job to job and from state to state. Some jobs (usually professional jobs) don't even have a maximum.
I have no idea what the rule is with live-in maids.

How do socialized health care proponents conclude that their is a "right" to health care when a right is something that cannot be taking away from you, and health care is something that people do not inherently possess?
They can make an argument based on the substantive due process clause, which gives you a right to life, liberty, and property. Liberty has been interpreted to include the right to use contraception or to send your children to public schools. The right to life could just as well include a right to health care. I'm not saying that argument is likely to win in court, but it's not a...

Suppose a firm wants to launch a new product on the market.how can the knowledge of the different types of elasticities might be helpful to him.
It will help the firm set the price for the product. If there is high cross-elasticity with competing products, they will have to set the price fairly low because the other products are considered a good substitute. On the other hand, if there is little cross-elasticity, they can set the price higher because people will not accept a lower priced product as a substitute.

Batting is scored by dividing the number of hits by at bats, and expressing it in 3 decimal places. If you batted 10 times and had 5 hits, you would be batting .500. If you had 10 at bats and 3 hits, you would be batting .333. If you batted perfectly, you would be batting 1.000.

No, not without the consent of *all* parties to the conversation. The only exception is if the content of the conversation cannot reasonably expected to be kept private. For situations that are not as obviously public, record at your own risk, as there are...

It is already happening for some of the more routine tasks. However, under the law, you still need a member of the bar (i.e. an American lawyer) to sign a paper that is submitted to a court or to actually appear for you in court.

Was it ever truly proven that Micheal Jackson wasn't a child molester? Just wondering.
He was tried in court once in a criminal case and the jury found him not guilty of the charges in that case, which involved one child. He was not required to prove his innocence. The government was required to prove his guilt beyond a reasonable doubt.
Whether it was "proven" in a non-legalistic sense depends on what you mean by "proven." I don't think it was.

The rights to TV shows and movies are usually split up by country. A person who owns the rights in the US to something may not own the rights in Canada. Entertainment lawyers cost $200 to $1000+ an hour, so it is very expensive to clear the rights for something in multiple countries. NBC probably decided it is not worth it (for now at least) to get the rights for worldwide internet...

Should we tell eight year olds that there is a one in twenty chance that they are homosexual?
You can tell them that 1 in 20 people are homosexual. However, it is a bit misleading to tell the 8 year old that there is a 1 in 20 chance *he* is homosexual. If the 8 year old thinks he is heterosexual, there is a considerably lower chance than 1 in 20 that he will turn out to be homosexual after puberty. If he thinks he is homosexual, there will be a higher chance.

It depends. First you have to know if the question is copyrightable. Short phrases are generally not copyrightable because they lack sufficient creativity. If the question is "what time is it?," then you can be safe in repeating the question.

Let’s say I pay an artist to create a product label for my company. Does the artist own the rights to the label including promotion/marketing or my company does? tx
Assuming the artist is an independent contractor (i.e. not your employee), the artist would own any copyright in the label. The solution is to have the artist transfer all copyrights and all other rights to the label to you in a signed writing.
Answer to:
If a competitor trademarked a very similar catch phrase, but my company was using it first, what recourse do I have? thank you
If you are able to show you acquired trademark rights first, you may be able to sue them for infringement and have their registration cancelled. You don't necessarily have rights just because you are first, so you should talk to a lawyer.
Answer to:
I would like to request a trademark for a restaurant, but somebody already has the identical mark registered with the USPTO for a completely unrelated business. The likelihood of confusion is almost nonexistent in my opinion. What are my chances?
It's hard to say since you haven't said what the trademark is or what the other party's business is. For example, if the other trademark is "Nike," it would be very dangerous to use that trademark. If the other trademark is "Joe's Place" for auto parts, then you have a better shot.

Answer to:

Answer to:

It may be legal to teach the fact religious people believe in creationism. However, it it is not legal to teach creationism as the truth. It is legal to teach evolution in public schools.

I'm looking to publish a book full of Art inspired by a particular band. How far would I be able to go in so far as mentioning them in an unofficial publication? IE reproducing lyrics, or lyric excerpts as part of the imagery, mentioning band by name etc?
Unfortunately, this is not a question that can be answered in the abstract. You would have to look at the work as a whole to see if it is fair use. I would have an experience copyright lawyer look at the finished work before selling the book to tell you whether it is qualifies as a fair use.
However, even if it is fair use, you may have to fight a costly lawsuit to prove it. It would be a...

Answer to:
In court, when a witness is sworn in, what is the difference between "swear" and "affirm?"
"Swearing" has a religious connotation. When you swear, you are promising to God you won't lie and putting yourself at risk of damnation if you do.
"Affirming" is a promise to tell the truth without such religious connotation. It is used for people who are non-religious, or for religious people, like Quakers, who believe it is immoral to swear to God.

If $1500 was lost from a cash in hand business but there is no register, no video, no proof of you taking it does someone have a case against you?
If there is "no proof," then by definition there is no case. If your real question is whether you need video or a register to constitute "proof," the answer is no. Someone's testimony that he saw that you had $1,500 and testimony of the owner that that the cash is now gone would be enough proof to have a case against you.

In the United States, the police are generally allowed to use a ruse to get a confession. It has to be beyond the pale before it gets to be unlawful.

Can a Canadian citizen file a civil suite against a U.S. citizen for mental abuse for financial gain and collect on it.
This would depend on many factors. First, where did the mental abuse occur? Second, where do you want to file suit? Third, where are the US citizen's assets? Fourth, how strong is the case on the merits?
If you think you have a case, go to a lawyer who will give you a free consultation. This may be something someone is willing to take on a no win / no fee basis.
Answer to:
How would I copyright the title of a book? (Book has not yet been written)
As others have said, it is difficult to have a copyright in the title of a book because most titles are too short to be copyrightable. However, once you start selling the book, you MIGHT acquire a trademark in it, provided it meets all the many requirements of a trademark. You should check with a lawyer if the title would qualify as either a trademark or copyrightable expression.

Answer to:
If someone trademarks a term many people already use as a name for a type of handmade craft people make and sell, can they make everyone else stop calling their product that when many people were using it before the trademark was filed?
You cannot own a trademark in a word that is a generic name for a product. For example, you cannot own a trademark in the word "car" for selling automobiles.
Since you did not explain the term you are referring to, it is hard to say whether this rule would apply in your case.

Answer to:
If "honesTEE" is a registered trademark, is "Hones-Tee" protected under that trademark?
The key to trademark law is likelihood of confusion. If an ordinary consumer might confuse honesTEE with Hones-Tee, then Hones-Tee would infringe honesTEE. Given that these marks are nearly identical, it is very likely a court would find Hones-Tee infringes, especially if the marks are used for the same kinds of goods or services.
