Is commons law marriage really legal?
In most places common law marriage is not legally binding specifically when it comes to social security, pensions, retirement plans, property ownership, taxes. If you have been with someone for 50 years, share all the bills, combined non-retirement investments etc...when one passes away assets will be allocated as though not married. The survivor will not receive the deceased social security...

If you file jointly they will take the entire combined return and apply to what he owes. Can I deduct the realtor's commission from my taxes?
You can deduct the realtors comission from your overall sales prices but it would only really have an impact if you found yourself owing capital gains tax on the sale of property. So if it was a rental property or you went over the $250,000 non-taxable amount allowed by law for the sale of a primary residence. It works like this:
Say you paid $100,000 for your home. The sale price (for...

My husband and I have a plan to pay off our house before our kids go to college, so we can help them with college. Is that the smartest use of our money? Or should we be saving for college instead?
Many schools with limited funds for financial aid depend on available federal funds. The federal formula does not include home equity as an asset, and the form you fill out to qualify does not even ask for information about family homes.
It would make little sense to pay off a home mortgage to move family savings out of the analysis of your financial need. If you use your savings to pay off...

I would start by figuring out what the basic cost of being you is. In other words write down how much your MUSTS are like rent, insurance, car payment, electricity etc. Then write down the expenses you have a bit more control over like cell phone use, groceries. Then the items you have total control over like entertainment, clothing, subscriptions etc.
This helps you figure out where your...

Are Roth IRA's good to get? I am 29 and looking at oppurtunities for investing...
ROTH is a great place to start building for retirement! You get to put money away and not pay taxes on the growth. So say you stashed away $10,000 and it grows to $40,000 by the time you retire (jusy using any number here to make a point), when you take the money out during retirement you pay NO TAX on the growth of $30,000. There is also a thing called RMD (required minimum distributions)...

My husband and I have a plan to pay off our house before our kids go to college, so we can help them with college. Is that the smartest use of our money? Or should we be saving for college instead?
I would say save for college in a 529 plan. Having equity in your house can reduce the amount of assistance you get when they start college. A 529 plan is interestingly not an asset of the child nor for estate purposes an asset of yours.

Negative (but not bankruptcy) info stays on your credit report for seven years. Credit reporting agencies cannot by law report charge-offs that are more than seven years old. Also Bush will leave the next president with an approx deficit of $400 billion. Nice mess to clean up huh?

Would you maintain a relationship with someone who is adamant about never getting married to YOU or letting YOU move in with them? Or would you go find someone who wants a future with you?
At least they are being honest and tricking you into believing they are someone they in fact are not. He/she is telling you very openly where this relationship is going. If that is not what you want, hanging around hoping for change leads to pain and disappointment and resentment.

Answer to:
What is the toughest part about raising a child?
Each new age has its challenges. For some it is knowing when to let go as others have mentioned. For others learning to be a parent and not a best friend. The key is put them first, communicate at their level, do not accept something that is "cute" now but awful later, let a child be a child but that doesn't mean all behavior is acceptable.

Your ex has moved on and if you ever plan to be happy you should work hard to do the same thing. It is clear from what you wrote, she feels differently than you. Leave her alone and let yourself be free.
Answer to:
Why is divorce always considered an act of failure? Is it possible to view it as a positive thing or a success in some way?
I think some divorces are a success not a failure. Not all relationships work. And keeping it together when it is clearly not meant to be and where both parties are unhappy then breaking up is simply the right thing to do. And moving on and allowing each to grow and get their happiness is a success.

If one of your friends was addicted to drugs or alcohol, would you tell someone even if it meant having the friend hate you? (purely theoretical)
I have. It was not easy. But in my mind, if you truly care for someone, it is worth the risk of losing them because if they do not stop you will definitely lose them.

My wife has been a bit secretive nowadays.she gets fidgety when i touch her phone.she says i spy on her and deletes a lot of msgs that she gets from one guy who is engaged.she gets atleast 5 msgs and min two calls from him.She replies to all his msgs.
I can understand how you feel but if she is doing something behind your back, yuor spying and making yourself sick is not going to change that. BUT if she is not doing anything, your spying will surely ruin your relationship. Hard as it is...you need support and you need to stop.

You probably do not want to hear this but in time you will feel better. Her fear is not something you can win over. Ok she is not gay but she could have said that and that she was not interested in you the same way you were in her.

Do i have to claim the money that is in my 401k on my taxes?
No. That is the beauty and purpose of putting money into a 401(k). You earn the money now but pay taxes later. It is considered "deferred". If you take the money out of your 401k before you reach the age of 59 1/2 then you will pay income tax and a 10% penalty too! Leave it in there!!!!

How do I save on taxes?
Depends on your situation. If you are self employed you can stash money into a SEP, SIMPLE, Solo K or other retirement plan which both reduces taxable income currently and grows on tax deferred basis. If you have cap gain issues, you can sell off "dogs" to both get the losers out of your portfolio and realize a loss to offset the gains. You can donate to charity if you file Schedule A...

If a person sells a house which was left to them in a will, keeping in mind that they lived in the house prior to the other persons death, would they be subject to the capital gains tax? If so, what percentage could they expect to be "whacked'?
If the house was left to you in a will then you will only pay capital gains on the difference between the fair market value on the day the owner died and the selling price minus selling costs. So if the house was worth $200,000 the day the owner who left it to you died and you sell it say 7 months later for $210,000 and paid a realtor $5,000 to sell it then your capital gains would be 15% x...

Your contract is not with your roommates but with the landlord and here in MA most rental agreements do not let you off the hook per se. However, if the lease was signed "jointly and severally" then legally althought the landlord retains the right to demand you pay up the remaining lease amount (which I am going to guess is a lot since it was the second day), he can also go after the...

There is nothing wrong with telling her you are not comfortable with it. You are not being a jealouse jerk - you are being realistic. AFter communicating this to her - the rest is up to her. You are not telling her to stop being friends. She needs to set limits with him and he needs to respect her relationship with you but the weight really falls on her.

Do you believe its fair for the US gov. to help the people who are forclosing on their houses due to getting adjustable rate mortgages? It never seemed to be a good Idea to reward the stupid so why is it now?
Because if the don't banks will own all the property and they are not in the business of owning property. And in cities where foreclosures are high, the buildings become abandoned and drive down the economy in that city even further. At some point it would cause a ripple effect throughout the US and if you think the economy is bad now WOW just wait.

If you had only met a man a month ago and already felt strong feelings for him, do you think it would be wise to leave everything and everyone you know for the oppurtunity of perfect happiness?
No. Why not give it some time and see how things go? This way the relationship has time to build and become stronger. If it is meant to be it will last the test of time and this way you do not "give everything up". Why would you have to give up everthing to have this relationship? That is an unhealthy start in my book.

Where do you draw the line when keeping track of your kids? (i.e. How much privacy do they have a right to?)
I think they deserve as much privacy as they earn the right to have. So until I have reason to not trust them - I do. Once they give reason to not trust then their privacy diminishes and they can earn it back. It is for me about trust. But giving them privacy does not mean letting them run free and wild without any parental guidance. It is a balance I think.

The problem here in my mind is the word blame. There are so many variables to consider here withour direct knowledge this is a hard question to answer. Does the child hear and see well? Is the child getting support from home around learning and school work? Is the child dyslexic? Does the child have some other learning disability? Is the child teased at school? Rule out all of these kinds of...

Can someone please explain what the Hollywood 10 is when America was in the era of Mcarthism?? And how stalin conquered east europe??? Please help
At the end of the war, Eastern European countries had been devastated. Millions had been killed. Famine threatened the survivors. Unemployment and inflation demoralized the people. The Nazis and the Soviet Union had wiped out the pre-war democratic leadership. National communist parties moved quickly to fill the political vacuum.
The communists promised the people of Eastern Europe a new era...

Can someone please explain what the Hollywood 10 is when America was in the era of Mcarthism?? And how stalin conquered east europe??? Please help
Just a little over fifty years ago, during the late 1940’s and throughout the 1950’s, there was a great fear of Communism in America and abroad. The House Committee on Un-American Activities (HUAC) was created in 1938 as a means to investigate and weed out Communists and Communist supporters from American society. Its first major attack was on the Hollywood film industry....

What is the least amount of money needed to buy a CD or into a mutual fund to make it worth the effort?
A CD is safe in that if it bank issues (vs brokerage issued) it is insured by the FDIC and it will never be worth less in actual dollars. But if the return is 2% and inflation is 4% you are losing purchasing power. If you have to pay tax on it on top of that - you are actually losing money.

Your starting point is whatever the grantor paid for it (way back when) plus capital improvements. Then you get the $250K each free ride...anything above and beyond that (you can subtract out selling expenses) is taxable.

It should show on the 1099R the amount wittheld. On the line of your 1040 where it says taxes withheld make sure you credit yourself with the amount showing on the 1099R. And you are going to be in for a surprise because although you feel this was already taken care of an early withdrawal not only gets taxed as income but there is also a 10% penalty on top and if you took out a lot, it could...
Answer to:
Does a 1040X form (amended tax return) take the place of the original or is it additional to your original? My 1040x states no refund!! Does this mean no additional refund? Will my original refund still be direct deposited?
If you made a mistake on your original return and this should be the only reason to complete a 1040X and when you refigured your return you are not supposed to get anything back and you already did, then you owe the IRS the difference and believe me you want to give it back.
Answer to:
I started a business this year. The financing came from a second mortgage on my house and credit cards. Can I claim that on my personal tax return or does the LLC get to claim those expenses?
You lent the LLC the money so you can take a deduction for the mortgage interest that allowed you to have basis in the LLC (there is a limit to mortgage int deduction however). What the LLC did with the money is then a deduction for the LLC (say it used the money to pay rent on an office).

My daughter is an aspiring actress, she attends workshops, goes to auditions in New York and also has a manager in New York. She is 13, can I claim any of her expenses on my tax return.
No. These are considered hobby expenses. If she makes money next year (say she does a commercial!) then you can use the expenses incurred in that year to offset income made in that year.
Answer to:
How do I report participation in an employee stock purchase plan on my tax return?
If you exercised and sold all on the same day, the difference shows up in your W2 as income but you still have to report the transaction on a Schedule D as well and typically that portion of the transaction shows as a little loss from the cost of the fees. This is not always so easy to report and if you feel lost I suggest getting help with it.
Answer to:
If my wife and I make all the payments on a second home that our daughter lives in, can we deduct interest and property tax on our tax return?

I sold stock and used the money as the down payment on a condo purchase. Turns out there was long-term capital gains on the sale of the stock - is there a way to turn this around on my tax return since I used it for my first real estate purch
Would be great if it worked that way but it does not. You have to pay the capital gain unless you have other stock which is showing a loss then you can at least offset some of the gain if you sell the other stock and in the same year as the gain.

In places where prostitution is legal, do hookers have to file tax returns?
Actually even though it is illegal here (except in certain cities in Nevada), prostitutes are supposed to fill out tax returns here as well. If you read the code (IRS code) it does say that you need to pay income taxes on ALL income whether by legal or illegal sources. Can you see that on the self-employment line when it asks what type of business you offer??!

You are supposed to file even if you do not owe. I would get the tax thing cleared up, all past returns filed as part of the court order or negotiation during the divorce. If you don't you are liable even after the divorce.

Should I stay or should I go? Married 22 yrs., 6 mo. ago discovered husband had affair/s for last 6 yrs., unprotected. Says he loves me, wants to keep marriage & family. Last 6 mo. he's been doing all the "right" things. Six years is a longggg time!
As previous person said 6 years is a loooooong time. But no one can really answer this question but you. It would be easy to say leave the guy but you have to live with your action. I think going to talk to a therapist may help you sort out your needs and feeling and that may ultimately help you decide. Best to you - this is a tough situation.

Because they are just starting to notice each other more intently. It is the beginning of puberty and this is when the world begins to be about more than your family and your block.

I'm thinking about investing in a rental property; 4-5 family. How would we pay taxes on the rental income?
It gets filed on Schedule E and Form 4562 (depreciation). Keep great records! You count the rental income as income on Schedule E then go through each line putting in the expenses (property tax, insurance, mortgage interest, repairs, maintenance and the mileage or tolls back and forth from your house to the property).
You also get to depreciate the building and the cost of appliances or...

Are there any investing tools specifically for saving for my child's college tuition?
There are a number of choices but a Coverdell Educational IRA and 529 Plans are the biggest. Avoid using UTMA or UGMA accounts because they are considered the child's assets which wil reduce any financial aid AND the child can take the money out at (in most states) age 18 and nothing the parent can do legally!

Are you actively investing for retirement?
Like crazy! I wish I had started when I was younger but when you are in your 20's (well when I was), retirement feels really far away (and it is) and not so important at the time. Social Security is never going to be enough and when the system started it was not supposed to be our only means of income in retirement (people still had pensions then!). Also we live so much longer the benefits...

What do you think is going to happen to the real estate market over the next year?
Well here in MA although the market is not as "off" as it is in other places...I think we have not seen the end of downswing (yet). More jobs have been lost across the US as a whole, inflation is about 4% and summer gas prices have yet to kick in.
Answer to:
If you missed a tax deduction on real estate last year can you file it this year?
You have to go back and ammend the return for the year of the missed deduction. You cannot add it to this year. For instance, in 2006 you forgot to put in your property tax of $3,000. You are no filing your 2007's. You paid $3200 in prop tax in 2007. You deduction for 2007 prop tax is $3200. You cannot increase it by the amount missed in 2006 to $6200. You have to reopen the 2006 return,...

Is a real estate agent different from a broker?
Same in MASS
Answer to:
Is real estate a good investment right now?
Real estate may be especially a good investment at the moment if you are looking to buy a home for yourself or to rent out since the prices have dropped. However, if you are going to rent it out, have some money stashed away for any period of time that it is not rented or the tenants do not pay. You have to have the stomach for it.
Answer to:
Do you enjoy being a real estate agent?
I was one for a while and it was not for me but some people like it. I found the hours to be 24-7 and no one likes you...not the buyer or the seller nor the other listing agent..so again not for me. I am sure there are positives for some though.

What are your opinions about equal tax for all?
Just an opinion here but I do think taxes are very complicated (when you get into the tough stuff) and that should be easier. The issue I think there would be with a flat tax (one mariganl rate for all) is that they would have to bring the high rate people down and the low rate people up to meet in the middle. Hence your low income folks would be paying more than they are now which for some...

Can spouses file separate tax returns?
Again Alex P is spot on. You can file separately but not sure why you would want to. Many adjustments or credits get taken away when you do this oft times resulting in paying a higher tax. There is that rare time when it is advantageous but typically the answer is no.
Answer to:
What's your best tax tip?
Alex P said it well. The other tax tip I have is that the better your records are the less you typically pay. This is particularly for those who itemize deductions or are self-employed. If you use you car for work and are not reimbursed by yur employer or if you are...
Answer to:
If I simply make a mistake during my tax preparation and I realize later that error cost me (not the IRS) money, will the IRS send me the difference if I alert them to the mistake?
If it is a math error they will generally just make the adjustment. But if you forgot to include something in the return or had additional deductions you forgot about you will need to file an ammended return (1040X).

The IRS has clinics where they help and many cities have community run clinics to assist you. Additionally, if your income is less than (I believe) $30,000 you can efile for free on-line. Go to www.irs.gov and there is a list of sites to efile for free. I think you have to pay for the state efile but the cost is minimal.

A judge could rule in her favor (maybe). There is a case in MA where two women got together as a couple and one birthed 3 children by insemination while they were together. The non birth mom never adopted legally. The split up and birth mom goes to court asking for child support which the judge grants her even though the other mom has no legal rights. Go figure.

Like the other person said, first you have to see if you have term or whole life. Then if you only had the policy a year, you will not have any cash from which to take the loan if it is whole life. Third is you still have to make payments every month to pay back the loan.

I am purchasing a second home and need to finance $50,000. In lieu of obtaining a mortgage and paying the closing costs, can I borrow on my life insurance policy and deduct the interest on the loan as an itemized "investment interest%
No. It doesn't matter what you use the loan from your life insurance for it is still considered personal interest.
Answer to:
Does it affect my credit rating if I borrow against my life insurance policy instead of getting a home equity loan?
Borrowing against life insurance is NOT a good idea. There is a limit as to how much you can borrow and the interest is not deductible. Additionally, most people never really pay it back and so the death benefit is reduced by the balance plus interest.

I was given some property several years ago which I am now selling. How will I figure out the capital gains tax to pay on it since I did not purchase it to begin with, how is the original price determined?
Depends on how you received the property. If you inherited it after someone else passed away it is called a bequeath and your beginning value is the value of the property the day the person passed.
If the person was alive when they gave it to you...uh oh...your basis (or starting point) is what they paid for the property plus improvements.

Not unless you used your car while working for an employer and you did not get reimbursed. Then you would have to know not only the cost of the gas, insurance, repairs etc but also the number of miles. THEN is is reduced by 2% of your adjusted gross income and THEN only if you itemize deductions.

What age is it when seniors are exempt from paying taxes on their intrests from annuities and other investments?
In some states age will play into this (like NM) but federally, age is not the issue - gross income is what triggers taxes. ALso you may be thinking about a non-qualifed annuity in which part of the distibution is return of original principal but the insurance company issuing the annuity ususally does that math for you (amount of distribution that is excluded as taxable).
By the way NM gives...

As a fmaily, we went on a mission trip to Mexico for a week. We drove and paid out of our own pocket. Can we deduct any of this on our taxes?
Mission trip is considered charitable. For the most part everything is deductible if you itemize your deductions. If any part of the trip was for entertainment (say two days you took off and went fishing) then you have to subtract out expenses related to that portion of the trip. If you do not itemize your deductions then although it is legally deductible, it won't show on your return.
Answer to:
My mother signed her house to her children a few years ago. She still lives in the house and pays the taxes and utilities. When sold, will we have to pay capital gains?
Oh gosh yes! Mom should not have signed the house over. Now when the kids sell, their starting point to determine the gain is whatever she paid for it when she bought it. Had you waited until she passed, then the starting point would be whatever the value of the house was the day you took title. This is called stepped up basis and it reduced capital gains.
So say she paid $20,000 for the...
Answer to:
My home is on the market - not sold. I purchased and am living in my new home, what deductions can I take on the unsold home, taxes, heat, upkeep, etc.
If the house is empty (not rented) the only thing you can take is mortgage interest and property taxes. It is personal property not business therefore you can only take personal deductions. If you rent it out, everything changes!
Answer to:
You've just won 72 million dollars in the Powerball! How are you going to (realistically) spend it? Factor in taxes and how you're getting paid back - installments or a lump sum.
I would not take the installments. In many states, if you take the annuity option (installments) you cannot will the balance to heirs. So let's say you get one payment and are so excited you have a heart attack and die....well it's all over! If you took the whole thing at once you can leave it someone (or me!!)

Answer to:
I inherited 5 acres in oregon when my mother passed away.the property is worth approx. 200.000 what am i looking at for capital gain taxes
If you did not take title to the property until after your mother passed away you capital gains on the sale of the property begins with the fair market value of the property the day you took title. The difference between that amount and what you sell it for is the gain and you pay taxes typically 15% on that amount. BUT if the value of the property dropped and you sold it for less than it was...

Answer to:
What is the percentage of taxes on capital gains for a rental property I have owned for 3 years in florida?
Federal cap gain rate for most taxpayers is 15% but since you rented the property you also have to pay taxes not only on the gain but on the recapture of depreciation. This means you have to add up all the depreciation you took or could have taken over the rental period and pay taxes on that amount in addition to the gain upon sale.
Answer to:
How are taxes paid upon the sale of the land?
Capital gains rate and luckily to depreciation recapture because you cannot (and should not have been) depreciating unimproved (read no building on it) land. So whatever you paid for it is where you start (and you can add acquisition costs such as attorneys fees etc onto that to bring it up legally) and then what you receive for it when you sell (then reduced by selling costs such as attorney...

My mother just sold property in a divorce and is living with me. Would she have to pay taxes on the proceeds if she were to invest the money in my home to add on a room for her?

My husband and I have lived in our home for 17 months and want to sell. Will we have to pay capital gains taxes if we sell before we have lived in the house for 2 years?

I work in MD during the summer for 7 weeks and live and go to school in PA the rest of the year. Preparing to file taxes, do I owe state or local taxes based on these 7 weeks in MD?
You have to file a tax return in MD and PA but you get a credit in PA for the tax you paid on money earned in MD. This is not an beginners return to prepare and I suggest seeking professional help.
Answer to:
I sold a rental house that had been rented for the past 5 years and I used the proceeds to help buy my permanent residence do I have to pay capital gains taxes on this money?
Yes. The property you sold was business property and hence it is subject to capital gains. In addition, you have to recapture (add up) all the depreciation you took as a deduction during the rental period and pay taxes on that too.

Can part of one's assets be protected from taxes and a potential nursing home by legally giving a one time gift of $10,000 to a relative who is a minor? From a resident in Massachusetts.
No.The look back period has been extended from three to five years. This means that the government has the right to examine all financial transactions a person has made within the past five years. For transfers of assets to individuals the look-back period had been three years and the new law extends the look-back for transfers to individuals. The look-back for transfers to a trust was already...

Hillary Clinton unveiling $110 billion universal health care plan: Will it mean higher taxes?
What will cost you more, paying for your own health insurance out of pocket or taxes for universal health care. At least health care is a good thing. The IRS just spent over $80 million send out a mailing to tell everyone they may get a stimulus check. Now THAT seems like a bog waste of money to me.

Are social security payments exempt from state and federal taxes?
If you are asking if social security income received is exempt the answer is sometimes. When you receive social security during retirement it can be taxed if you have other income over $25,000 and filing single. But typically if social security is your only source of income, then your benefits are not taxable.
Answer to:
Why do churches not pay taxes?
Because they are considered a non profit organization and non profits do not pay taxes. The theory is that a non profit is organized to provide service of public or private itnerest without any profit purpose in mind. Whether you feel churches fall into that category is another story!

I recently divorced and from his buyout of the house, I have about $40,000. I assume I will pay taxes on it this year, yet I would like to invest it for about 1 or 2 years and perhaps get some sort of tax shelter. Any advice?
DO NOT tax random advise from a website. $400,000 is a lot of money. You NEED to go see a Certified Financial Planner. Many things come in to play such as your age, your other assets, your debts, your risk tolerance, do you have an emergency fund of cash on hand and a dozen other things.
Answer to:
I worked for a general contractor and tax was not deducted, as he had suggested 1099. Now he claims that I owe the taxes to him directly. What's the proper method for filing, and is the request legitimate?
You do NOT owe taxes to him. If he paid you via 1099-MISC you file a Schedule C (sole proprietor) along with your 1040 and pay taxes directly to taxing authorities. He is scamming you BIG TIME.

If you were claimed as a dependent on your mom/dad tax return, which excludes you from Earned Income credit for your own child, what are the chances of the IRS spotting this?
Forget the smart *ss answer. The odds are 100% they will catch it. They cross match social securoty numbers. In this case she/he who files first stands the better chance of winning. But you could file, wait to get the letter from the IRS and then tell them the situation. They can be reasonable you know!

My father owns a condo, wants to put my name on the title and transfer it to me through a quit claim deed. Will he have to pay capital gains tax?
You may not want to do this if you ever plan on selling the condo. He does not have to pay cap gains because he is not selling it. It will be considered a gift and I am assuming it is way over the $12,000 non taxable gift that he can give you in one year.
The reason I mentioned you having an issue if you sell it in the future is that because it is a gift (vs. bequeath or inheritance), your...

I travel for work. Can I claim this as a legal deduction when I file my tax return?
You can also potentially deduct travel expenses even if you work for someone else IF your expenses are more than any reimbursement they give you for travel AND if you itemize your deductions on Schedule A. If you do itemize and your employer has not reimbursed you fully, then file a Form 2106 which will carry over to Schedule A.

My wife won $60,000 on a lottery in 07 and we were taxed $15,000 we made $50,000 last year. I have $60,000 in losing lottery tickets can I use them to wright off on my taxes and would it even be a good idea or will the IRS rip me apart?
Legally you can write-off losses only to the extent of winnings. So the wins shows up on the front of 1040 (the entire amount won, do not reduce it by tax withheld etc). The tax withheld shows up on the back of 1040 (on tax withheld line). The loss (only exact amount = to the win) shows up at the bottom of Schedule A (gambling loss).

Actually you can claim her. Any student under the age of 23 who you support more than 50% is your dependent. Make sure she does not claim herself (although she has to file). She will get all her taxes back and you will get the benefit of having her as you dependent. A reduced exclusion is available if you have had a change in place of employment, health or unforeseen circumstances (read death or divorce) and one of those issues necessitated the sale.

Ask him. If you file taxes jointly (and you do not have to even though you are married) you can become responsible for his tax debts too. You can then file for Innocent Spouse Relief but I suggest not filing jointly (of course this is not based on any additional info you would need to provide if you were a client of mine). Also any property you own jointly could wind up with a lien on it so I...

Answer to:
Can I take money from a 401k to pay alimony? Without paying tax or penalty?
The rule is: if you take the money out yourself you will pay taxes and 10% penalty. Some 401ks do not allow for any kind of premature withdrawal while you are an active participant. You should check your divorce decree and see if they wrote in a QUADRO then the money can come from the 401k without any penatly to you.

If you win the lottery and owe back taxes, do all your winnings go to IRS or just what you owe?
Lottery winnings are taxable. But casino's (and it depends on what state you are in) only withholds Federal tax at 20% of that winning. The casino cannot witthold all of your winnings to go towards taxes. They do not know you owe. But if you owe then I would save the winnings to pay the taxes.

Can you negotiate with the IRS on overdue taxes?
You can negotiate but they are tough. There is a thing called Offer & Compromise which can be filed to get them to accept a lower amount than you owe. If you have a pretty compelling argument could be worth a shot. If you have time, and a strong constitution you can do it withhout an attorney who will charge you.

Can you file your taxes without your w2
Depends on if you are paper filing or electronically filing. Paper file you must attach W2. Efile, if you know your employers federal ID number than you could potentially use your last paystub if you knew which part of your benefits were taxable or not. In general not a good idea to do it without the W2.

1099-INT gets filed with and on your 1040 not individually.
Answer to:
I was the Personal Representative for my aunt's estate. How do I enter the fees I was paid as income on my 1040 form? It was reported on a 1099MISC. Do I have to use Schedule C, and if so, what code number do I use?
You do have to include it but not on Schedule C. Put it on line 21 of your 1040.
Answer to:
My daughter took a hardship withdrawal from her 401K in the amount of $5000. She has set up monthly payments to pay it back. She received a 1099B on the full amount. My question is how is this handled? Does she have to report it and pay tax?
1099B is the wrong form. If she took a hardship withdrawal she should have received a 1099R and if it was a withdrawal then she has to include the entire amount as income and pay a 10% penalty on top of that. If she took a loan and still works at the same place then they should be taking loan payments to pay off the 401k loan directly from her paycheck.

Answer to:
If you make $100,000 with a wife, 2 kids and want to withdraw $20,000 from an IRA, what are tax implications? I think it is 10% penalty, plus it counts as income. How much of that $20,000 would go to uncle sam?
You are right. If you are under 59 1/2 and took money prematurely from an IRA you have to include the $20K as income AND pay an additional 10% penalty on the entire amount. Given your scenario you will give up about $4,000.

Federally you could be in the 5% or 15% rate category.
5-percent rate
This capital gains rate applies to taxpayers in the 10-percent or 15-percent income tax brackets. They will pay a maximum 5-percent long-term gains rate on property held for more than a year. The 5-percent rate still applies to a portion of your gains even if your asset sale pushes you into a higher bracket.
15-percent...

Can you deduct stocks that you sold for a loss from your taxes?
First you can deduct the loss against any gain meaning if you sold other stocks, bonds or mutual funds where you made a profit, the loss can first be used to reduce that or eliminate if the loss is greater than or erqual to the gain. In addition, you can also reduce another $3,000 of earned income with the loss. So if you had $1,000 of gains (for instance)and $5,000 in loss, the $1,000 gain is...

We acquired a rental house last year, spent a fair amount on repairs, and started renting it out in December. In 2006 our allowable net rental loss was $16000. Can we opt to carry this loss forward to apply towards our 2007 rental income? If so, how?
the first thing you need to do is determine if the work you did was a simple repair or a "do over". Do overs are larger expenses like a roof, new windows, extensive plumbing or electrical work. Those kind of things have to capitalized and taken over a period of time and not all at once in one year. New appliance etc also need to be taken over time.
Answer to:
How do you figure a NOL carryforward? Would it be the amt. (If we were using a tax software and had it calculate tax liability on 1040) with and without the loss and subracting this amt from the NOL carry forward from last year?
NOL carryforward: you have to make the election in the year you have the loss. If you did not do this then you have to go backwards before you can go forward.
But if you did make the election to not carryback, then the remaining loss unused can be then used to offset business income in the next year. It applies only to business income (salary, rental property etc). Also if you file a...
